Just One Thing: The NCAA loses (again)
I had Colorado Attorney General Phil Weiser on my show yesterday talking about his joining a multi-state bipartisan lawsuit against the NCAA’s rule that a student athlete who transfers between colleges a second time will not be eligible to play during the first school year after that transfer. It’s clearly a massive infringement on a student’s freedom and, try as I might, I cannot find a strong argument in favor of the NCAA’s position. Apparently federal judge John Preston Bailey can’t either because yesterday he barred the NCAA from enforcing the rule, noting that the plaintiffs, including the State of Colorado, are likely to win the trial when it happens on the basis of NCAA violating anti-trust law by engaging in restraint of trade, a legal term of art. The NCAA sure does seem to be losing a lot lately.

Comment from Andy McCarthy (to me by email): "If I’m Jack Smith, I’m worried because his application of the same statute to Trump is more of a reach than DOJ’s application of it to rioters. Interesting Supremes did this the day after they signaled they might entertain Smith’s request that they look at Trump immunity claim now — Smith only wants then to look at immunity, but he may have bungled into inviting the Court to scrutinize the charges in his Trump J6 indictment, which is the last thing he should want."
