WHICH OF TRUMP'S EXECUTIVE ORDERS WILL STAND? Pretty much everything that Trump is doing right now is going to be challenged in court. Though the President clearly has the right to issue Executive Orders, is he addressing things that aren't in his chain of command? I've got Constitutional scholar John Yoo on today to talk about it.

WHEN A PROSECUTOR GOES ROGUE This story is like a Lifetime movie and is a perfect example of why I reject "Believe All Women" out of hand. A now former Denver prosecutor accused a male colleague of making inappropriate sexual comments to her via text message, which she showed to her other colleagues at work. The story starts when Yujin Choi–who previously worked in the family violence unit at the DA’s office accused Dan Hines, a criminal investigator in the office, of sending a text message that said:

“Yujin, please stop talking about what I didn’t do to our colleagues. You are using your looks against innocent people. If you want to act like a sex doll to get a sugar daddy . . . fine, but that will not be me.”

At least that's what she told colleagues. She said she deleted the message but she showed what she said were screenshots of that and other text messages she said were from HInes to her supervisor and an investigation was begun. When it came time for her to hand over her phone and computer so they could be checked out, they conveniently were destroyed just before she handed them over. Now she's been disbarred and Sherrie Peif from CompleteColorado.com is joining me today at 2:30 to share more.

WHY HOUSING FIRST ISN'T WORKING I've had recovering homeless reporter David John Heitz on the show before, and as a person who had some significant mental issues that left him homeless, he is now on a path to recovery living full time in supportive housing. But he writes here about the failure of the way Housing First is done here in Denver, and why putting people who are trying to recover in housing with those who just want to continue their addictions without treatment is a horrible idea. Oh, and the Fusion studios property where he lives hasn't had water for FOUR DAYS. The City of Denver is a slumlord. He writes about the reality of what's happening at Fusion here. HOW LONG WILL THIS EVICTION TAKE? It will be interesting to see how long it takes to evict the man putting swastikas in the window of his apartment at Congress Park now that the property managers have put him on notice. I reported that Ross Envolve was working to evict the man and now the Denver Gazette is too, but it will be interesting to see how long it takes to get him out. In Denver, the deck is stacked against landlords in a BIG way. Keep an eye on this one.

THE COLORADO EDUCATION BLUEPRINT Though this column is about D11 in Colorado Springs, the authors could have looked north to Douglas County as an example of what happens when a school board puts kids first instead of unions. But I'll take using D11 as an example. Read it here.

THE KING SOOPER STRIKE IS HITTING GIRL SCOUTS HARD Because it coincides with the annual cookie sales that take place right outside most King Soopers stores. The Girl Scouts say they could lose millions, and if I'm a business with good foot traffic I'm inviting them to set up shop outside my joint for sure.

THE WALMART FOUNDATION FUNDS CLIMATE PROPAGANDA This annoys the crap out of me. I have been accused in the past of taking a certain position because so-and-so advertises on an IHeart station, with the implication that somehow I am doing their bidding. An advertiser on IHeart has NO control over ANYTHING I say, trust me. But when a foundation with a climate agenda funnels money DIRECTLY into the coffers of so-called non-profit news organizations I'm supposed to simply look the other way. Nope. Read about it here.

WE DON'T NEED MORE EARLY CHILDHOOD EDUCATION Because it DOES NOT IMPROVE STUDENT ACHIEVEMENT. How do I know? Because of the federal government's own study of the Head Start program. You can find that study here. Let me grab the important part for you here:

The advantages children gained during their time in Head Start and up to age 4 yielded only a few statistically significant differences in outcomes at the end of 1st grade for the sample as a whole.
Cognitive Outcomes. By the end of 1st grade, only a single cognitive impact was found for each cohort.
Social-Emotional Outcomes. By the end of 1st grade, there was some evidence that the Head Start group in the 3-year-old cohort had closer and more positive relationships with their parents than the control group. These impacts were preceded by other social-emotional impacts in the earlier years.
Health Outcomes. For the 4-year-old cohort, there was an impact on child health insurance coverage at the end of 1st grade.
Parenting Outcomes. For the 3-year-old cohort, there were favorable impacts on use of time-out and authoritarian parenting at the end of 1st grade. Specifically, those favorable impacts consisted of less use of time out and spanking. For the 4-year-old cohort, there were no significant parenting practices impacts in 1st grade.

More importantly is the follow up at third grade of these students. This report isn't celebrated with its own fancy webpage but it is FAR more important. Here is the important bit:

In summary, there were initial positive impacts from having access to Head Start, but by the end of 3rd grade there were very few impacts found for either cohort in any of the four domains of cognitive, social-emotional, health and parenting practices. The few impacts that were found did not show a clear pattern of favorable or unfavorable impacts for children.

And this is from the Federal Government's OWN multi-year study on Head Start and its impacts. Now we've got Aspen looking to create a special taxing district for more early childhood education that isn't going to do a single thing for student achievement long term. It's time to end the charade of the usefulness of early childhood education and invest those dollars in LATER supports for students that may have an impact that matters. But that's not what the teachers unions want. They want districts to hire more overqualified daycare workers.

THE NCAA AFFIRMS TRUMP'S ORDER ON TRANS ATHLETES And they will ban men who decide they are women from competing against biological women going forward. I think they must secretly be thrilled to have this hot potato off their plate. Either the NCAA or the AP who wrote this story still used the idiotic language I continue to refuse to adopt:

The college sports association's updated policy states that competition in women's sports is limited to student-athletes assigned female at birth only. It also states that a student-athlete assigned female at birth who has begun hormone therapy (e.g., testosterone) may not compete on a women's team. Student-athletes assigned male at birth are still allowed to practice with women's teams and receive benefits such as medical care while practicing, the policy states.

We aren't "assigned" a gender at birth, we are born a male, a female, or an intersex person. Period.
